AGB – General Terms and Conditions BucciMoto AUT/GER

Some products are unlocked from withdrawal. This includes perishable goods and products that have been custom-made for you, for example Pitbike motorcycles, MiniGP bikes. Furthermore, very delicate and sensitive products such as electronics and spacers (shims) are excluded. Products that cannot be returned by post, software, audio and video recordings from which the seal has been removed, and gift vouchers are also excluded from revocation.

To exercise the right of withdrawal, the customer must  (BucciMoto Austria /Germany, owner Manuel Wondrak, Kapellenweg 9, A-8504 Preding) by means of a clear statement (e.g. a letter sent by post or e-mail) of the decision to withdraw from this contract. The customer can use the model cancellation form below, but this is not mandatory.

To meet the cancellation deadline, it is sufficient for the customer to send the communication regarding the exercise of the right of cancellation before the cancellation period has expired.

Consequences of revocation

If the customer withdraws from this contract, BucciMoto AUT/GER – OFFICIAL shall have all payments that BucciMoto AUT/GER has received from the customer, with the exception of shipping costs and any additional costs resulting from the fact that the customer chooses a different type of delivery than the has chosen the cheapest standard delivery offered by BucciMoto AUT/GER, immediately and at the latest within fourteen days from the day on which BucciMoto AUT/GER received notification of the cancellation of this contract from the customer. For this repayment, BucciMoto AUT/GER uses the same means of payment that the customer used for the original transaction; under no circumstances will the customer be charged for this repayment. BucciMoto AUT/GER can refuse the refund until BucciMoto AUT/GER has received and checked the goods. The costs of the return are borne by the customer.

The statutory rights of the customer, in particular the statutory right of withdrawal and the right to guarantee, remain completely unaffected by the above regulations.

§ 4 Delivery
Unless otherwise agreed, delivery will be made from the BucciMoto AUT/GER warehouse to the location specified by the customer
Shipping address. Information about the delivery period is non-binding, unless the delivery date is exceptionally binding

§ 5 Maturity and Payment

§ 6 Retention of title
The delivered goods remain the property of BucciMoto AUT/GER until full payment has been made

§ 7 Liability for Defects
If there is a defect in the purchased item, the statutory provisions apply. The assignment of these claims of the customer
is excluded.
Unless otherwise stated below, further claims of the customer – regardless of which
Legal reasons – excluded. BucciMoto AUT/GER is therefore not liable for damage that is not caused to the delivery item itself

If the supplementary performance is by way of a replacement delivery, the customer is obliged to use the goods that were delivered first

legally regulated requirements to claim damages.
The limitation period is twenty-four months from delivery.

§ 8 Warranty, Guarantee, Liability
Unless otherwise stated, the vehicles (called pit bikes) are fun and racing items,

Fun and racing items are generally sold by us as a kit with the associated legal provisions,

The pit bikes are in the original box  and are as we get them from the manufacturer
80-90% pre-assembled.
Even if the pit bikes are largely pre-assembled, they may only be put into operation
if these have been properly assembled and checked or if the functionality of a
specialist workshop was secured. For this service, we offer you the option of assembly using one of ours
authorized workshops (please inquire about the costs by e-mail).  Supplied batteries are not part of the product and
are therefore not covered by the guarantee. If you set it up yourself without a specialist workshop authorized by us, any warranty claims are void. the
Operating instructions and safety instructions must be observed and complied with. The functionality of the pit bikes is
checked and ensured before each use. We are not liable for accidents or other events from the
operation of the pit bikes, we also exclude any liability for the use and professional installation of
spare parts. Claims for damages can therefore not be accepted. Don’t buy a pit bike or none
Replacement parts if you do not accept these terms or are unable to operate the pit bike properly.
The sale to dealers and resellers takes place without warranty and guarantee.

§ 9 Product Liability
In the event of strict liability as required by law, in particular for personal injury
(Injury to life, body, health) according to the Product Liability Act, we or our sub-supplier are liable

we are only liable for intent and gross negligence. This restriction also applies to our vicarious agents,
